Terms and Conditions

These Terms and Conditions govern your use of all services provided by RegenZ (Pty) Ltd, including this website, the Regen Connect platform, and the Reggie Bot WhatsApp advisory service. By using these services or registering for the Reggie Bot, you agree to these Terms.

1. About These Terms

These Terms and Conditions ("Terms") govern your use of all services provided by RegenZ (Pty) Ltd, including this website (www.regenz.co.za), the Regen Connect platform, and the Reggie Bot WhatsApp advisory service (collectively, "the Services").

By accessing this website, registering for any RegenZ service, or signing up to the Reggie Bot, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. The Parties

"RegenZ", "we", "us" or "our" refers to RegenZ (Pty) Ltd, a company registered in South Africa, with its principal place of business in KwaZulu-Natal.

"You" or "the User" refers to any individual or organisation accessing the Services, including farmers, growing group members, aggregators, funders, and other stakeholders.

3. Regen Connect and Reggie Bot Service

3.1 Description of Service

Regen Connect is RegenZ's digital farmer engagement platform. The Reggie Bot is a WhatsApp-based advisory service that provides soil health guidance, fertiliser and input information, agronomic tips, and access to RegenZ programme support.

3.2 Registration and Consent

By registering for Regen Connect or the Reggie Bot — whether via WhatsApp opt-in, a field enrolment form, or any other registration mechanism — you:

  • Confirm that the information you provide is accurate and complete;
  • Provide your informed consent to be contacted via WhatsApp as part of the Regen Connect service;
  • Agree to the collection and processing of your personal information as described in Section 4; and
  • Acknowledge and accept the agronomic disclaimer set out in Section 5.

Consent may be withdrawn at any time by replying STOP to any Reggie Bot message or by contacting us at info@regenz.co.za.

3.3 Use of the Service

You agree to use Regen Connect and the Reggie Bot only for lawful purposes and in accordance with these Terms. RegenZ reserves the right to suspend or terminate access without prior notice where a user is in breach of these Terms.

4. Protection of Personal Information (POPIA Compliance)

RegenZ is committed to protecting the privacy and personal information of all users in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and its Regulations.

4.1 Information We Collect

When you register for or use our Services, we may collect the following:

  • Identity information: name, surname, and identity or registration number;
  • Contact information: phone number, WhatsApp number, and email address;
  • Location information: village, ward, municipality, province, and GPS coordinates (where provided);
  • Agricultural information: farm size, crop type, soil health data, input usage, and agronomic records;
  • Growing group information: the name and details of the growing group or programme to which you are linked; and
  • Usage data: interaction records with the Reggie Bot and Regen Connect platform.

4.2 Purpose of Processing

We collect and process your personal information only for the following lawful purposes:

  • To register you and manage your account on the Regen Connect platform;
  • To deliver the Reggie Bot advisory service via WhatsApp;
  • To link you to your growing group and facilitate communication with your group coordinator;
  • To monitor and improve crop outcomes, soil health, and farmer livelihoods;
  • To comply with legal and contractual obligations; and
  • To report anonymised or aggregated programme outcomes to funders or CSI partners (see Section 4.4).

4.3 Sharing of Farmer Data

We will not sell, rent, or commercially exploit your personal information to third parties. Your personal information will only be shared in the following circumstances:

1. Growing group sharing: Your agricultural data and programme records will be shared with the growing group to which you are formally linked. This is necessary to coordinate input supply, technical support, and market access within your group.

2. Programme coordinators and field agents: RegenZ field staff who manage your growing group may access your records in the ordinary course of providing the service.

3. Aggregators and processors: Where your programme includes a market linkage component, limited data (crop volumes, quality grades, farm location) may be shared with the aggregator or processor linked to your growing group, solely to facilitate market access.

4. Funders and CSI partners: We share anonymised or aggregated data only. No individually identifiable information will be shared with funders without your explicit written consent.

5. Legal compliance: We may disclose your information where required by law, court order, or lawful instruction from a regulatory authority.

We do not share your personal information with any party outside of your growing group without a lawful basis for doing so.

4.4 Data Storage and Security

  • Your data is stored on secure servers and cloud platforms with appropriate technical and organisational safeguards;
  • We retain your personal information only for as long as necessary for the purpose collected, or as required by law; and
  • We take reasonable steps to protect your information against unauthorised access, loss, alteration, or destruction.

4.5 Your Rights Under POPIA

As a data subject under POPIA, you have the right to:

  • Access the personal information we hold about you;
  • Correct inaccurate or outdated information;
  • Object to the processing of your information on reasonable grounds;
  • Request deletion of your information, subject to our legal retention obligations; and
  • Lodge a complaint with the Information Regulator of South Africa.

5. Agronomic and Soil Health Recommendations — Important Disclaimer

Please read this section carefully before acting on any recommendation provided through the Reggie Bot or Regen Connect.

5.1 Nature of Recommendations

The soil health assessments, fertiliser recommendations, input guidance, and agronomic information provided through the Reggie Bot, the Regen Connect platform, and any other RegenZ communication channel are provided for informational and advisory purposes only.

These recommendations are not made by, and do not constitute advice from, a person registered as a professional natural scientist (soil science) or an agronomist registered with the South African Council for Natural Scientific Professions (SACNASP) in terms of the Natural Scientific Professions Act 27 of 2003.

In terms of South African law — and specifically the Fertilisers, Farm Feeds, Agricultural Remedies and Stock Remedies Act 36 of 1947 (as amended), and the Natural Scientific Professions Act 27 of 2003 — certain agronomic and soil science recommendations may only be provided by duly registered professionals. The content provided through the Reggie Bot and Regen Connect is intended to support and complement, not replace, registered professional agronomic advice.

5.2 Limitation of Liability for Agricultural Outcomes

To the fullest extent permitted by applicable South African law:

  • All recommendations, guidance, and information provided through the Reggie Bot, Regen Connect, and this website are provided without warranty of any kind, whether express or implied;
  • RegenZ does not guarantee any specific agricultural outcome, yield improvement, soil health result, or financial return arising from use of the Services;
  • Any decision to apply a fertiliser, input, biological product, or agricultural remedy based on information provided through the Services remains the sole responsibility of the user; and
  • RegenZ shall not be liable for any crop loss, input cost, financial loss, or consequential damage arising from reliance on information provided through the Services.

5.3 When to Seek Registered Professional Advice

We encourage all farmers — particularly those making significant input investment decisions or dealing with serious crop health concerns — to consult a registered agronomist or professional natural scientist before acting on any recommendation. RegenZ can assist in connecting farmers with registered professionals where required.

6. Intellectual Property

All content on this website and within the Regen Connect platform — including text, images, graphics, logos, and software — is owned by or licensed to RegenZ (Pty) Ltd. You may not reproduce, distribute, or use any content without our prior written consent.

The Beyond Soil Life™ brand and associated product names are trademarks of RegenZ (Pty) Ltd (trademark application pending).

7. Third-Party Services

The Reggie Bot operates via WhatsApp, a service provided by Meta Platforms, Inc. Your use of WhatsApp is subject to Meta's own Terms of Service and Privacy Policy. RegenZ is not responsible for the availability, security, or conduct of WhatsApp or any other third-party platform used in delivering the Services.

8. Limitation of Liability

To the fullest extent permitted by South African law, RegenZ's total liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the amount you have paid to RegenZ (if any) in the twelve months preceding the claim.

RegenZ shall not be liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of data, or loss of agricultural output.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. Amendments

RegenZ may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Services after any amendment constitutes your acceptance of the revised Terms. Where amendments materially affect your rights, we will endeavour to notify registered Regen Connect users via WhatsApp or email.
